INJURED ON THE JOB AND NEED HELP?

The Pennsylvania Federation of Injured Workers can help you understand your rights under the PA Worker's Compensation Act.  If you need some information about PA's Worker's Compensation System or you need a little support to make it through tough times the PFIW is here for you.  We help injured workers because "An Injury to One is an Injury to All"!

P.F.I.W. MISSION

To offer education about the PA Worker’s Compensation System to workers and the families of workers who have been injured or made ill at the workplace; and otherwise to work to improve the living standard of injured workers and their families; to support research and other actions that will benefit injured workers and their families and reduce workplace injury and illness; to advance and safeguard the full employment and economic security of injured workers generally; to support, encourage, and engage in support of philanthropic projects or activities which sponsor the purposes of the PFIW, is the sole purpose of our organization.

Get the Right Legal Representation!

When it is time to get legal help for your workers compensation claim know the right questions to ask an attorney.  It is important to select an attorney that will go the distance in the legal battle to protect your right to receive workers compensation when injured on the job.  Once you sign an attorney agreement it is next to impossible to change to get a better attorney.  Most attorneys will not take a case that has had a previous attorney.  This is the most important decision you will make for your future.

Ask the Right Questions!

Get the Best Medical Care Available!

When injured on the job the employer will send you to a physician selected and listed on a panel physician list that is posted at the job site.  It is important to know that there is a reason the employer has chosen that particular physician to be a company panel physician.  The physician has agreed to treat any work injury with as little expense as possible.  This may lead to the injury not receiving aggressive treatment necessary for a complete recovery.  In Pennsylvania, injured workers must treat with an employer selected panel physician for the first 90 days after the injury.

When Possible get the Physician You Choose!

HB961 - Bad Legislation for Injured Workers

Expressed opinion by Michael A. Kerstetter, PFIW Dauphin County

A bill is about to be brought out of committee and voted on.  The HB961 will force injured workers to treat with an employer's panel physician for 180 days instead of 90 days.  The PFIW has taken a stand on this legislation and does not support it in any way or form.  This Legislation will open the door for medical malpractice lawsuits since it allows an employer to force an injured worker to treat with a panel physician that may put medical costs before the well-being of the injured worker.

The reasoning used by the authors of the bill is as follows:  It is first important to note that the Bureau of Workers' Compensation must perform an annual Medical Access Study to gauge the satisfaction of those injured workers being treated under the current system.  The 2004 Study which was recently released by the Bureau indicates a relatively high level of claimant...more

Pennsylvania's Workers' Compensation Act 57

This legislation was passed the same way the recent 2005 pay raise was passed.  It was voted on and passed during the late hours of the night without any public debate opportunity.  The legislators hoped this bad worker's compensation reform legislation would go unnoticed by the majority of workers and it did.  Many workers are under the impression they will be taken care of in the event of a workplace injury.  In many cases this is not true.  The standard practice of employers is to deny a serous work injury to save on insurance premiums or for self-insured's medical costs.

A television ad campaign by the insurance industry, which portrays injured workers as criminals and worthless, is a disgrace to us all.

A commission on workers compensation has been established this year to gather information for workers' compensation legislation reform to be submitted sometime in December 2005.

INJURED WORKER DAY OF PROTEST & MEMORIAL DAY - APRIL 28, 2004

Expressed opinion by Michael A. Kerstetter, PFIW Dauphin County

On April 28, 2004 the Pennsylvania Federation of Injured Workers in junction with other injured worker advocate organizations and advocates sponsored an injured worker rally at the Capitol Rotunda Gallery in Harrisburg for an Injured Worker Memorial Day event. This was a day to remember workers who were killed or injured on the job. We need to attract attention to the way Pennsylvania is allowing injured workers to be exploited by employers and the insurance industry. Injured workers are struggling ...more

Injured Workers May Die Because the Pennsylvania Legislature Fails to Make Them Whole Again

Expressed opinion by Michael A. Kerstetter, PFIW Dauphin County

Many of us go to work, in Pennsylvania, with the assumption that if we get injured on the job that our injury and our finances will be taken care of by workers’ compensation.  This may be true for a majority of injured workers but there is a group of injured workers that falls through the cracks of a broken system.  This small group is there due to two reasons.  First, the employer is denying the injury and second, the injured worker has chosen an attorney that is not quite up to par on workers compensation law.

If an injury goes on for several years the employer, most of the time, fires the employee so that medical and other benefits package can be discontinued and their cost of business can be lowered.  If the injured worker has been out of work due to his/her injury for more them two years and a Social Security Disability claim has not been filed for the injured worker, then all eligibility for Social Security Disability may be lost.  Through no fault of their own the injured worker more...

WHAT CAN YOU DO FOR CHANGE?

Many times we are asked; "What can I do? I am only one person".  The answer to that is very simple.  When a large number of people complain about something it tends to get attention.  The real power to make change comes from injured workers and injured worker advocates who have registered to vote and do so.  They vote for politicians who care about injured worker rights.

If all injured workers and injured worker advocates would register to vote and get one other person or more to do the same, injured workers would then be able to say; "the abuse of injured workers stops now."

That is all it would take for injured workers to be heard in Harrisburg.
